This week on EJR, I will discuss the impending end of the Chevron Doctrine. First created to establish EPA regulatory power, the doctrine has allowed federal agencies such as the EPA to create regulations consistent with the law, while reflecting the judgement of various experts in multiple fields. It makes sense as professionals in the fields to be regulated would better be able to craft sensible rules, as opposed to members of congress. Now the Supreme Court is poised to strike down this 40 year precedent. Once reversed, the public would have no protection from corporate greed. There would be no regulations to ensure the safety of our medicines or our food, no regulations governing labor law or environmental concerns. In theory any regulations would either have to be listed in the law, like items on your grocery list--or wait for Congress to add to the law. This is our big story.
