Clear and Indisputable Injury: The nature and extent of the injury should be obvious and well-documented. No Prior History of the Injury: The injury should not be a pre-existing condition that was merely aggravated by work. 2. Employee vs. Independent Contractor: Workers comp only applies if you're a regular employee with taxes taken out of your paycheck, not an independent contractor. 3. Indisputable Accident Evidence: A strong case involves an accident that is clearly witnessed and reported immediately, reducing the chance for the employer to dispute the claim. 4. Nature and Extent of the Injury: Clear injuries like a broken leg with immediate diagnosis and visible symptoms make for stronger cases than less visible injuries like neck pain, which can be contested more easily. 5. No Prior History of Injury: If there is no prior history of the injury and it's clear that it was caused by a work accident, the case is stronger compared to cases where there is a documented history of the same injury.
