The Criminal Justice Act and the CJA Guidelines (CJA) ensure that court-appointed defense counsel can secure funding for fees and expenses related to retaining experts, investigators, and other professionals, including paralegals and interpreters, to support the defense.
You can currently contract for up to $2,400 in fees in non-capital cases with prior authorization by the presiding judge.
· Investigators', experts', and other professionals' expenses are reimbursable and do not count against the fee maximums.
· If you know that the expert fees will probably exceed the $2,600.00 limit, you will need to apply to the presiding judge for certification that funds over the maximum are necessary.
· This request is forwarded to the Chief Judge of your Circuit Court of Appeals, who holds approval authority.
